thanks a lot kshitijnt.... my gc has been filed about 5 months back. At that point I wasn't planning to shift to PF otherwise i wudn't have made them file it. ya, as u said i shud have started with PF directy. Just because my company filed for h1b, i didn't wanted to ditch theem. Now I realised that its foolish in this fied to be considerate for someone especially desi employers.

Krithi: Can you please let me know how to go to Adv Parole side. Although we have had them but have never used them before. So I need to guide my wife towards this AP area.
So in order to show or use AP my wife has to go and line up in the visa queue OR she has to go to Permanent Resident/Citizens side and from there they will route to this AP check/processing area. Please advise.
Sorry with my fundamental questions but I have never used my APs till now.

You have to go and line up in the visa line NOT citizens/PR line (since you are not one). Just carry all relevant docs - EVL (if applicable), receipt notice copy of 485, both originals of AP, etc...

It is legal per INA to do that.. So your letters and your friends letters are just gutted in the trash right away.. :p
I agree.. Remember labor substitution was also legal once upon a time. However when people reported the facts to USCIS the labor substitution was banned..

140K GCs are available on Oct 1. But, dates are not current. Based on this, there appears to be a law that prevents USCIS from recieving ALL AOSs. I am guessing that this law specifies a cap on AOSs that USCIS can recieve from lawyers. (This is why I am keen on knowing conditions for setting dates in VB)
The following argues that it is hard for this cap to reach exactly on the end of every month.
It is impossible to believe that this cap was not violated in June when it is possible that USCIS got 200K-600K AOSs.

the first 3 quarters cannot use more than 27% each
that is the whole issue
on the first working day of the month/quarter, where were the remaining 19%
that should be available by law?
how can they allot them on sunday (july 1)? if so they must be willing to accept my application on sunday too...

There are lot of people whodo investments,have kids and buy houses and everything else when they are on H1.
I don't see any reason to hold off things on H1. If your wife did master's why don't get her on H1, there are so many job openings available in market.
Instead of crying, take some action
She has been trying for the past 5 years... She is not in IT. She would get past all the interview processes etc but when it comes to finalizing the papers with HR etc comes the final blow. "No visa sponsorships, Sorry !! "
Seeing all her friends climb up the ladders.. doing well in different areas and you being left helpless is difficult to digest. She has been volunteering, working with different Societies, charity organizations. But keeping yourself busy is not just what she wants to do.

Guys thanks for your appriciation on my recent blog "Power Behind A Flower". Please note that the reason behind this writing is to help our movement and encourage people to fight against injustice. Now the question is what's next??
With a successful flower campaign to USCIS, we must draw our conclusions from this success, and use the outcome to make the San Jose rally a success.
Please note that legal immigrants is a small handful set of people. Just a usual rally/demonstration will not make a dramatic impact. We have learned from the flower campaign that if we use innovative-peaceful ways of demonstrations, and manage Public Relations and Media well, we can be successful once again.
Please think and try to come up with some ideas. I have come up with these four ideas:
1. Project Martin Luther King Jr. as our hero in these rallies: Please understand that local Amrican people better understand about Martin Luther King Jr. andhis idealogy then M.K. Gandhi. My suggestion is that we should include large picture posters of Martin Luther King Jr. with a slogan "We legals too have a dream". We should also take Gandhi's posters. There is a possibility that all Black American organization may lend their support to us.
2. An act that attracts media attention: Please remember the scene from Gandhi movie when protesters led by Gandhi peacefully burned their resident permits in South Africa. To do something similar and show our symbolic protest against USCIS, we can publically burn a Photocopy of our H1B approvals (I-797). Please note that we are not asking people to burn the original I-797 approval but a photocopy of the document. This will send a message that taking the great pain in obtaining these legal documents are not helping us getting a better treatment by USCIS. This act will perfectly portrey the pain of legal immigrants and once again will attract media and newsprint to keeps us in headlines. This should be part of our demonstrations.
3. Waive American Flags: Please understand that recent media reports that only Indians are responsible for the flower campaign may hurt the campaign in the longer term. Please waive small American flags and show our solidarity with local Americans.
4. Distrubute a flower with a pamphlet to the people passing by at the demonstration site. A well worded paper will be required that can project our problems to the people.
Please share if you come up with innovative ideas to make these rallies a huge success.

Whats the game plan here?. What will this letter do?. What if we dont get reply?.
We dont give them any room here. We are not letting them decide anything. We provide them options and they have to choose one. If they dont, we sue them.
Options according to me. Feel free to correct/add folks.
1.Process Green card in a consistent manner and provide Green cards who have been waiting for a while and make it current.
2. Refund every DAMN dollar for all the million applicants who didnt get it.
If they are not choosing either, we are SUING. No second thoughts here. We are under the water already.

If the employee needs to leave after two years and if he has had a good track record, relieve him in good terms, don�t scr** him.
If the employee helps in your business, you got to help him too (Just like the referral policy), don�t think that just because he works for you, he is obliged to help you in your business in other means, it is not in his list of roles and responsibilities.
It is the employer�s duty too to find projects, if the employee finds project for himself, then reward him with bonus.
Above all, the desi employers need to come out of cheap mentality and become more professionals.

Up until July 29, 2007 (incl.) when sorting of files was going on, NSC did a load sharing of files with TSC. (and btw they did not look at where ones' I-140 is adjudicated when making the selection, it was random. I know several such cases)
This in my opinion is a very good way of making sure adjudicating resources are kept in balance at both centers.
Like somone quiet rightly pointed out it is akin to the old Labor Certification process where some states were way faster than others (less demand faster process).
In the direct filing which started July 30, 2007 the load sharing has a great possibilty of being tilted one way or the other (though maybe not as much as old LC's). They have made a geographical distribution and not one that factors # of applications traditionally received from states.
On the other hand, may be USCIS has figured that the particular geographical jurisdiction produces the right load sharing between NSC and TSC!
CA and NY were the two states which were always backlogged during those bad old days of labor processing. Now, CA application goes to TSC and NY goes to NSC and that might keep both the centers balanced going forward.
But I think rather than dividing based on the states, they should rather do a load balancing based on the request coming..just like our network works :)

How difficult is to build that kind of system and to keep it balanced and fair for all.
