I think your idea is good. But this could be very difficult to implement, at least for USCIS.

Another suggestion is that porting should be automatic. As soon as a person acquires the required qualification for EB2 + a letter from the company that the person's future job will be of EB2 caliber, UCSIS should put him/her in EB2 category. This is some thing we should work on.

Have you contacted anyone about your ideas? Allowing everyone to port from EB3 to EB2 will solve a lot of problems that America faces today. Except Global warming of course.:D

Seems like they have or are going to block all mass e-mails in future..

Pappu: I did leave messages for Immigration Aide @ Senator Brown and Senator Voinovich office and have not heard back from them.. Will update once hear back from them.. Seems they all are already in holiday mode..

Thank you for contacting my office. I genuinely appreciate your e-mail and thank you for sharing your thoughts with me. As with all communications with my office, your views have been recorded.

Every day, I hear from the people of Ohio through their phone calls, letters and faxes to my office. As you can imagine, I also receive a significant number of e-mails daily. Mass-generated e-mails sent by a third-party group, which are usually form text, have hindered my ability to respond to the e-mails, phone calls, letters and faxes that I receive. Due to the increasing number of mass-generated e-mails received by my office, effective March 16, 2007, my office will be implementing changes to the constituent correspondence process.

Consequently, I have established a new system on my website to better serve Ohio constituents. If you would like a written response to your e-mail, please go to .: United States Senator George Voinovich :: Home :. (http://voinovich.senate.gov) and click on the CONTACT tab to fill out the web CONTACT FORM. By filling out this form, you will receive a written response from my office.

Thank you for your patience. Should you experience any problems with my web CONTACT FORM, please call my office at 202-224-3353 and my staff will be happy to guide you through the electronic correspondence process.

    Sincerely,

    George V. Voinovich
    United States Senator

I think it depends on who the primary applicant is in your Canadian PR application. If you are the primary applicant (and used your spouce's qualifications to get the extra points), you should be able to do the landing alone. But if you are the secondary applicant and your wife is the primary then I don't think you can land without her.

I think the rule is that the secondary applicants cannot land until the primary applicant has landed. (So the secondary applicants (spouce, kids) have to land either with the primary applicant or after him.

Last week i received a letter from my canadian lawyer to send my passport to buffalo for stamping. The last date mentioned is March,08

Regarding me, I got through canadian immigration with mine and my wife's points. My wife is a Permanent resident for last 3 years 10 months in US. I am in EB3 category. PD Oct 06.

When checked the rules for maintaining PR in US for my wife, She cannot apply for PR in any other country till the time she is a PR in this country. As per the lawyers she will have a difficulty in applying for citizenship.

Now, I cannot myself apply for canadian immigration. because its a joint filing. What should i do?

For those wondering what's going on in this thread...here's a brief synopsis:

We are collecting pledges to file a lawsuit against USICS against these random and opaque processing of GC's. Our target is to get 1000 affected people to pledge atlaset $100 each so that we can fund this lawsuit. No money being collected right now..just honest pledges.

There is a current list of members who have pledged support on the link below.
    http://spreadsheets.google.com/ccc?k...8fcKLTQ&hl=en#

If you would like to help in this effort, please send me a private message with the following info:
    1) Ur IV handle
    2) Ph#
    3) Email ID
    4) Amount you would like to pledge.

Please note, we will move forward only if we have atleast 1000 pledged members to make up a sound force behind this campaign. So unity is the key here. We will not collect money unless we have a solid proof that we are not alone in this fight.

Once again..we have nothing to lose...but a big gain if we can gather enough support and raise our voice against thsis open injustice.

if the only way to reduce the backlog of EB3 is to port to EB2, why EB3 category at all. Just remove that category... Maybe lawyer's should come with a better alternative than giving this lame advice. EB3 category are still employed for the past 10 yrs - shows that they are required-then why not fight to get their number of visas increased or the spill over be applied to them equally as to EB2.

For people who have already landed and were not able to get a PR card applied, please follow the following link and apply for it.

    http://immipedia.ca/CIC_call_centre

You need to have the following documents with you when you make the call:-
    1. Landing Paper which you got stapled to your passport.
    2. All the people who landed, as you cant apply for your spouse or kids PR.

Please let me know if you have any questions.

    Take this scenario.

Under current "mis categorized quota" setup a EB3 takes 6 years to get GC for entire family. take this following scenario.

    So the diff
    current primary @ebquota - 6 years minimum
    current derivative @ebquota - 6 years minimum
correct primary @ebquota - less than 2 years approx ( one person in place of 3)
    correct derivative @fbquota - say 7 years.

The diff will be approx 1 year for the derivative ( 7 years – 6 years ) when they are moved from ebquota to fbquota.

again it cannot be more than 7 years ( 2 years primary GC + 5 years primary USC). the primary will get citizenship in 5 years and sponser the wife with in 2 to 3 months. so the diff cannot be more that a year. for derivative.

Remember this point: this is not change of law. this is the correct interpretation of law).
If it is not today some one will bring it up to CIS very soon.

If you are USC and then you are talking abou the FB2. Not for the GC holder. So will have to wait for years.

    EB3_SEP04,

My Receipt and Notice date is July 03, 2008, however there was a soft LUD on my case on July 08, 2008. And again another LUD on August 14, 2008 which is the approval.

    Thanks
    Raghav235

Raghav, congrats and thanks for the update.

Is July 08, 2008 also the Notice Date on your receipt notice? I'm wondering if generally there is one more LUD after the notice date and before the approval, when they pull the file off the shelf and start working on the case.

for me no LUD after notice date.

Please email all your senators using the text in the quoted box below. Most websites have the contact form page where you can fill out the text box with the message. Copy-paste the message from below. Add a short description of your profession and the number of years you have been waiting for greencard. Dont add too much of your own story, and stick to the message below.

You can add your own message like "My name is .... and I am from city, state. I have been waiting in queue for greencard for legal skilled immigration for X years. ".

    How to find senator's website:

Find the 2 senators of your state first and then email these 10 important senators mentioned below. Go to www.senate.gov to find the website of each senators :

Tip: If you have Google toolbar, then its very easy to autofill your name/address on the websites of senators below.

    Patrick J. Leahy http://leahy.senate.gov/contact.html
    Arlen Specter http://specter.senate.gov/index.cfm?FuseAction=ContactInfo.Home
    Chuck Hagel http://hagel.senate.gov/index.cfm?FuseAction=Contact.Home
    Dianne Feinstein http://www.feinstein.senate.gov/public/index.cfm?FuseAction=ContactUs.EmailMe
    John Cornyn http://cornyn.senate.gov/index.asp?f=contact&lid=1#contact
    Harry Reid http://reid.senate.gov/contact/email_form.cfm
    Mitch McConnell http://mcconnell.senate.gov/contact_form.cfm
    Mel Martinez http://martinez.senate.gov/public/index.cfm?FuseAction=ContactInformation.ContactFor m&CFID=22272398&CFTOKEN=66357958
    Trent Lott http://lott.senate.gov/index.cfm?FuseAction=Contact.Email
    Lindsey Graham http://lgraham.senate.gov/index.cfm?mode=contactform

    How to find contact email/info:

Most senators have "Contact me" or "Contact us" menu item. The would either have email address or mostly a web-form where you can fill out a form to send an email. Use that facility.

    What message to send:

Dont forget to replace [your name] space at the bottom of email text with your real name.

Put "Legal skilled immigrants to face more backlogs and delays" in the subject line of email. Some Senator's websites have a drop-down list to choose the issue you want to talk about.

Then copy the message in the quote box below.

    Dear Senator:

Subject: Treating the currently backlogged legal skilled immigrants at parity with undocumented immigrants and family-based applicants in the Immigration Reform bill S. 1348.

Immigration Voice (www.immigrationvoice.org) represents the interest of 500,000 legal skilled immigrants in the United States on the path to green cards who have been stuck in enormous backlogs and delays in immigration process.

The career growth, job mobility and quality of life of these half a million legal skilled immigrants is subverted by the bill in its current form.

    1. Section 501(b) reduces the number of green cards to legal skilled immigrants from the current 140,000/year to 90,000/year and diverts the major portion of those green cards to future low-skills guest workers under the Y visa program. Instead of increasing that number to reduce the backlogs this section take a step backwards and would exacerbate the backlogs. On the other hand, 503(f)(2) of this act would allocate an estimated 11 million green cards over a time frame of 5 years – 2.2 million a year – to undocumented immigrants. Immigration Voice requests congress to treat legal skilled immigrants at parity with undocumented immigrants and increase the number of green cards to at least 250,000 for 5 years for currently backlogged applicants defined under Sec. 502(d)(2) in order to reduce to current backlog before the untested points based merit system is functional.

    2. Immigration Voice requests congress to waive per-country ceilings on backlogged petitions to be processed under Sec. 502(d)(2) in order to make the backlog reduction more efficient. The bill provides a very similar waiver from per-country ceilings to family based pending petitions in section 508(b).

    3. Immigration Voice requests congress to allow legal skilled immigrants to file for adjustment of status for those applicants who have been certified by DOL to be doing jobs no US citizen is willing, qualified or able to do. This would be at parity with provisions for undocumented immigrants who would qualify for instant work permit (probationary card) that allows them to work without employer sponsor and without department of labor’s certification simply by registering.

Immigration Voice strongly opposes the bill S 1348 in its current form and requests congress to amend this bill and treat the legal skilled immigrants at parity with undocumented immigrants, future guest-workers and pending family-based applicants.

    Thanks,
    [your name]

    Folks

However, this one department called USCIS is literally toying with us for yrs now as if we are slaves or we are obligated to them. We dont want anyone to do us any favour. We need justice.

Friends - I have self respect and i wasn't born chanting Green Card. I AM going to face them, confront them, demand them to provide justice, if not I want them to REFUND every penny i have paid so far. If this "I AM" becomes "WE", half the battle won. TOGETHER WE STAND, VICTORY/JUSTICE FOR ALL. If you are still hesitant, you made a bad choice of choosing option 2. Please go back to option 1.

    ITS ABOUT TIME.

Could you provide details on your POA (Plan Of Action) .. how are you going to go about facing them, confronting them, demanding justice? I'd be happy to pitch in.

If the CIR seems likely to pass, I believe Sen. Cornyn will push for this bill to be added to the CIR as an amendment, much similar to what Sen. Durbin did with the DREAM bill. Amongst the bills I have seen, this bill is the best one so far. Agreed it does not address all that we want....but compared to where we are, this bill will achieve a lot for us. Especially, if the AOS clause passes, it pretty much means that you can file I-485 i.e. it means that you and your dependents become eligible for EAD and all the benefits associated with it. :)
