    So is it a problem if you try to go for landing AFTER you apply for AOS?
    What about those who landed before they filed i-485?

    I google'ed and came across not-so-good information about this.

    or just google "canada landing while I-485 pending" and read other links as well. Some attornies think accepting canada greencard MAY impact USA greencard! :eek:

    Incorrect

    As per law one should have intent to work full-time for the employer (or AC-21 employer) at the time of approval. There is no time period specified.

    The intent, of course, can change after some time. Lawyers differs on the duration. Some argue it is 90 days, whereas others suggest 180 days or 1 year.

    Are you sure about that...never heard of I140 portability. If it were true...why would there be such a big ho ha about AC-21.

    Iam a novice at this, and am by no means contradicting your point...just skeptical..

    To be more accurate, it is not porting I-140, it is retaining your old priority date, and using it with your new I-140 petition.

    When you move, your new company will have to start the GC process from the begining - Labor, I-140. It is just that when they file your new I-140, you will have to provide a copy of your old one and request to keep the old priority date.

    I think there are some requirements to get this right - one of them being your job classification should be the same. There is a thread on this subject somewhere on this forum, you can dig it out and ask questions there.

    Not sure if its a BREAK or no Visa numbers...


    There were a couple of approvals today from TSC by looking at the other site.But slowed down a lot. Maybe USCIS is taking a break this last week and preparing for the next month:)

    I was just wondering that how come only desi employers are branded as "blood sucking manicas" etc etc ..? Doesn't there exist same kind of breed from other nationalities ? if not, then question is why we desis are like that ? any idea ?

    All the desi employers I ran into or my friends ran into turned out to be blood suckers. before that I was employed by an american company for 6 years and I had no complaint whatsoever.

    I think most of us desis consider other desis to be inferior and treat them so.

    Was your I-140 approved also at NSC? Maybe that's the reason why you have an NSC receipt. My I-140 was approved from TSC.....

    My 140( in 2006) was from TSC and 485 from NSC

    Just saw the below mail from one user in immigration portal dot com....not sure some say Visa numbers are done for this year and same time we see Approvals...May be the below one gives some hopeeeeee....Just a little bit ...





    Just checked the online account AND the 800 no. status. I see the following status email:

    On September 8, 2008, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

    Below are my details:

    PERM Labor filed : 07/0105
    PERM Labor approval date : 09/19/2005

    I-140 and I-485 filed on: 09/26/2005
    I-140 Approval date: 01/26/2006

    First FP:10/18/2005
    Second FP: 04/19/2007
    Third and Last FP: 09/03/2008

    I-485 Approval Date: 09/08/2008

    Filed for Expedited AP on 07/22/2008. That was approved on 08/14/2008.
    Went to India on 08/19/2008 and came back to US on 09/01/2008 to do FP as lawyer's office had emailed me about the FP letter they had received right after I had left!

    For I-485, took help from local congressman's office in 2007 for name check clearing and security check clearing. They also helped me last month for getting the FP appointment letter for expired FP.

    Finally, thanks to you all and this forum for uncomparable help, free info., insights and opinions.

    I wish good luck to all of you that have pending cases.

    In my case, i do not have a valid H-1B visa stamp. I recently visited India and used Advance Parole. Questions related to this

    1) do i need to surrender my PAROLE I-94 before departing USA?
    2) does canada immigration officer ask me why i have applied for canada gc while my USA gc is in process?:confused:

    Im really not sure if this helps EB3 cases. for example in my case i have a bachelors degree + 10 years expereince and stuck in EB3. I dont think this will help me because I dont have an US degree.

    Correct me if im wrong.

    noob question: your signature states a PD of 4/04 and EB3.
    How can you file your I485 now?

    Am i the only one not up to date?

    Simple - ROW (aka Rest of World). Different "countries of birth" have different current Priority Dates

    You'll notice from the excerpt below that the current (June 07 bulletin) for my particular category is June 05
