    thanks indigokiwi. The deadline is end of March, but we would like a large amount of this raised much earlier, since it involves making reservations, booking appointments, for Eg. with the lobbyist.
    We need to raise about $1000 everyday to meet the goal.

    Thank you very very much fightnow and gsc999 for pushing this forward. As soon as we have confirmation of date and time and location/route, I will send out newsletters to all CA, NV, AZ and OR members who wish to participate. This is going to be good.

    Also, I will email all Bay area newspapers and tech periodicals that legal skilled immigrants are having to run rallies on the street instead of designing the routers and the next iPhone.

    I applied for EAD and AP renewal on June 30. I received AP approval on July 18th and got EAD approved on August 15th.

    Summary of AC21 law provisions poste above.

    (1) It is not necessary to work for GC sponsoring employer prior to getting GC
    (2) USCIS should be advised (after 180 days of AOS pending) with new job offer (in same/similar classification), and your intentions of using AC21
    (3) Sponsoring employer can not withdraw I-140 after 180 days of AOS pending
    (4) Sponsoring employer CAN withdraw I-140 within 180 days.

    July 2 filers should keep their sponsoring employer happy until Dec 29, with no suggestions that you might be thinking to leave. Do whatever you want thereafter.

    I just visited last month. I stayed there for 6 weeks...

    Agree that economy is booking but....

    (1) too much pollution.
    (2) No infrastructure to handle cars and two wheeleers.
    (3) too much mosquito even in winter/summer. I do not know what will happen in rainy days.
    (4) prices for every item have gone up by 3X..Most of the item I am not able to justify the rise. The quality of the product has not gone up.
    (5) easy to set up business..get house...get car but tough to drive peacefully...need to pray god every morning so that we come back home with 2 hands and 2 legs and unbroken body parts.
    (6) Club culture is booming too...so if you have daughter who is teen then need to check by that angle too.

    Just my two cents....

    Agree to all of them. but biggest thing to beat them all above in US is Medical insurance. you can live here in this country as long as everything is going well.
    Talk about the Job situ, if you are out of job for a month, its a hell..but not in India.

    thanks for taking the initiative and donating again manish1905. It is sad to see only a few 100 'active. Most people want to see results before donating, but most don't realize we can't get results without thousands working first for many months.
    So its up to us to work extra hard to achieve things that will benefit 500,000 people.
    Things like Visa Recapture, which benefit 100s of thousands benefit everyone including EB3, as there are only about 40-60,000 EB2s left.

    Quite right, I know you meant that managing relationships has to be from both the sides, but with most desi employers it has become a one way street. Even with all the effort to manage relationship, the employee still gets scr*** and this needs to stop.

    ...he may just approve even if you show the self employment will be in future (for future job requirement for GC), and he may agree for your "projected income".
    Suppose you're on the 3rd month of a 3-month contract on self-employment in same/similar occupation (a "permanent" job). Now, can't you say your "projected" annual income on self-employment, esp. if the project is *likely* to be extended for an unknown period? Another scenario: In a month you're *expected* to start working on a three-month project (@$60/hr). Can't you calculate your annual income ("projected," of course)?


    I think you have not read recent horror stories in H1B. They are just like that denying majority of H1B.
    Statistically speaking, there is always a high probability of H1B getting denied than for GC. Also, H-1B fraud (and now L1, EB1-GC "frauds"), esp. by desi IT bodyshoppers, is more prevalent (as noted by BusinessWeek) than GC fraud. In any case, just because a large number of H-B petitions are getting rejected, on *genuine* grounds, you can't assume the same proportion of GCs getting rejected.


    If the petitioner does not provide commitment/contract from end client for the entire duration of H1B period, H1B approval impossible. H1B is a temporary job; just think how much they will scrutinize for GC.
    H1B is a temporary job from USCIS perspective. Most of the time the employer is hiring an H-1B to fill a FT, "permanent" position. Why would that employer (e.g., an R&D or oil company) give the commitment for, say, just 3 (initial) years of contract? Most of the time, the employer has *intent* to keep the H-1B on that same job after GC.


    Those golden period are long gone. This is enforcement period as US unemployment rate is in double digit.
    Current recession/depression doesn't mean the USCIS/DOL flout their rules/laws (e.g., AC21)--it just means they need to follow the rules more strictly and reject any potential fraudulent cases. This enforcement is only going to increase as it takes more time for the economy to bottom out. Law-abiding H-1B and GC petitioners need not fear that.


    AC21 memo is a non-binding memo. Tomorrow they may release another memo or regulation that repeal the self employment in AC21 cases.
    If AC21 memo is non-binding, which immigartion law is binding? We can go with only current rules/laws; the rest is speculation.

    pd2001_12...i can understand your pain. In a usual gregorian calendar date terms, my pd might be close.

    But in USCIS Retrogression calendar terms, I might be millions of miles away from your priority date...:mad::(:confused:

    It is correct. We are talking about both kinds of kids. And saying that not having greencard affects the quality of life for the family.

    Agreed. better might have been,
